Purpose

Section 47 reports provide the court with written information regarding factors affecting a child’s welfare in family law cases.

Ordering Reports:

The court, as the ultimate guardian of the child’s welfare, can order these reports directly or upon the request of one of the parties involved, such as a parent’s solicitor or barrister. These reports can only be ordered in the Circuit Court.

Who Conducts Them:

These reports are typically conducted by child psychologists or other court-authorized professionals. However, there are no specific regulations regarding their qualifications.

Party Satisfaction:

It is not just a formality but a crucial aspect that all parties must be satisfied with the qualifications of the individual conducting the report, empowering them in the process.

Fees:

The cost of the reports, a shared responsibility of the parties, is covered by them, with the court determining the share each party must pay. If the report author is called to testify, the parties are also responsible for covering their expenses.
