Section 32 Reports: Overview and Guidelines

Purpose

As of January 2019, the following professionals are eligible to act as experts under Section 32:

  • Child psychiatrists with over five years of practice
  • Child psychologists with over five years of practice
  • Social Workers with over five years of service to children
  • Registered teachers with over five years of experience teaching children

Who is an Expert?

The court, as the ultimate guardian of the child’s welfare, can order these reports directly or upon the request of one of the parties involved, such as a parent’s solicitor or barrister. These reports can only be ordered in the Circuit Court.

Standards for Experts:

  • Independence: Experts must act independently and without bias
  • Role Explanation: They should explain their role and purpose to the child unless doing so is against the child's best interest or if the court directs otherwise
  • Child's Views: One of the critical standards for experts is to ensure the child's freedom to express their views. This is a fundamental aspect of the process that must be respected and upheld
  • Non-influence: Ensure the child's views are not unduly influenced by others

Insurance:

All experts involved in Section 32 reports must have professional indemnity insurance, a strict requirement that cannot be overlooked
